Leave the gun in the car at school parking lot?
Can I leave the gun in the car at school parking lot where there is no 30.06 sign?
Thanks for responding. I really appreciate it!

This is related to your other post obviously. If you have a CHL, you can keep your guns locked in your vehicle. 30.06 doesn't have any meaning on a campus.

It does for a private college, but as you noted it has no impact at a public college.oohrah wrote:30.06 doesn't have any meaning on a campus.

Why would you want to leave a gun in a cat?ericeric11111111 wrote:Can I leave the gun in the cat ?

Sorry. That is a typo. I mean leaving a gun in a car. What you mean is that when there is a 30.06 sign on the front gate of the garage, I can not park the car with gun into the garage. Am I correct?RetNavy wrote:Why would you want to leave a gun in a cat?ericeric11111111 wrote:Can I leave the gun in the cat ?

That is not correct. You are legal with the gun in the car.ericeric11111111 wrote:Sorry. That is a typo. I mean leaving a gun in a car. Yes. I have a CHL. No matter there is 30.06 sign at the garage gate or not, I can leave the gun locked in the car which is parked in that garage. Am I correct?jbarn wrote:That is not correct. Re: Leave the gun in the car at school parking lot?
yes. The principle is that the 30.06 sign bans carry under the authority of your CHL. But since it is not illegal to have a gun in your car, you do not have to have a CHL to do this. Thus, you are not carrying under the authority of your CHL and the 30.06 sign does not apply.ericeric11111111 wrote:Yes. I have a CHL. Re: Leave the gun in the car at school parking lot?
No, the statute prohibiting carry on campuses applies to all colleges, public and private, so a 30.06 on any campus is meaningless and unnecessary. A 30.06 imposed on the parking lot would only prevent carry outside the vehicle in the lot, since as several have pointed out, anyone can possess under MPA if they keep the gun in their car.Jumping Frog wrote:It does for a private college, but as you noted it has no impact at a public college.oohrah wrote:30.06 doesn't have any meaning on a campus.
The 2013 legislation prohibited colleges, public and private, from imposing rules on faculty, staff, and students. Previously, a student could have been suspended for keeping a gun in their car, not for a violation of the law, but for a school rule violation.
Bottom line, anyone can have a gun in their car in a college parking lot, under MPA. Faculty, staff and students can keep guns in their cars if they have CHL.

Re: Leave the gun in the car at school parking lot?
The buildings are off limits my statute but the grounds are not. Alice Tripp made that point during one of the campus carry hearings but I don't know if that's what caused some private universities to post 30.06 signs on campus to make the grounds off limits.oohrah wrote:No, the statute prohibiting carry on campuses applies to all colleges, public and private, so a 30.06 on any campus is meaningless and unnecessary.

Technically true, however, when the grounds are in use for school activities, they are also off limits by statute. Unlike K-12 schools, college campuses, the grounds, are constantly in use by students walking to class, studying under trees, etc. I don't want to be the one arguing with the DA over tecnicalities.

I don't see how walking to class or studying under a tree is a school sponsored event at a college anymore than it could be in a High School.oohrah wrote:Technically true, however, when the grounds are in use for school activities, they are also off limits by statute. A school activity would be an organized practice, sanctioned sporting event, or an outdoor class lecture. This doesn't mean that because a class decided to sit under a tree in order to observe a bug that the whole campus grounds are off limits. In any of these situations as a passerby you would just need to keep as much distance as possible between you and the event to ensure you are not mistaken as a participant or an observer.
