Further, that assault is aggravated if the other person is using a deadly weapon. Seems to me that under these circumstances, if you just shot the guy and he died by the time the cops arrived, they would find him there with his knife, blade exposed, in his hand, and your prints are nowhere on his person or the knife. A knife with an exposed blade is a deadly weapon for sure, so it would seem to me to be the end of the story: I can't see how a grand jury would indict under those circumstances and under the Texas law code. If it would be argued that you used excessive force, or over-reacted, what is the difference if the perpetrator took out a pistol and showed it to you, threatening you if you reported to the police? Both the knife and the gun are deadly weapons, and I can't imagine anyone arguing that you would not be justified in shooting the perp if he took out a gun and threatened you.

My main concern, as I stated in my original post, is that there are thousands of people in Texas, maybe even millions, who are driving illegally, or who have outstanding warrants, who might very well pull this on you in a similar situation, and that if they get a free pass to threaten victims with knives on the roads not to report to the police, aren't we just enabling this and letting them get away with it? Maybe somebody needs to send the message that you cannot threaten someone with a weapon and not get shot?
Having outstanding warrants is not unexpected in conjunction with the behavior described.

This clearly wasn't the first time he'd done something stupid.

The chances of being attacked by a knife wielding attacker that is actually skilled with an edged weapon are likely the same or LESS than being struck by lightning. If one is of the mind set they have no defense against the attacker, you have already lost the fight

Given the information you've presented, were I in that position, I would have drawn. Now, whether I would have fired or not depends on their reaction after I displayed my firearm. If they backed off, then I would just call the police (though I'd stay unholstered and at the ready). If not, then I'd shoot until the threat was stopped and then I'd call the police.

I am making a few assumptions here, of course. No provocation, nothing illegal or threatening regarding your actions, etc. If there are different facts not listed here, well, my opinion could change.

I'm not eager to shoot someone but this fellow may have very well had two, three, or more smoking holes in him depending on just what RottenApple said above and I would worry about the Grand Jury later. One way or the other he would still be there when the police arrived. With or without said holes in him would be entirely up to him.

I have two favorite quotes. My first is.... "He should have armed himself, if he's gonna decorate his saloon with my friend".
My second is... And by coincidence, would apply as they were loading him in the body bag. "Typical bad guy. Brought a knife to a gunfight".

I will say this. Anyone pulls a knife on me and doesn't include the words, "check out this cool new knife I bought" or "Here, let me help you get that DVD out of the plastic" , is going to be shot. I won't wait be waiting to find out if the aggressor is planning to use the thing on me.
