I am looking into whether or not I can get my CHL. The only thing that might be an issue for me is that I could potentially have two class c misdemeanor offenses that both ended in deferred adjudication.
The first was an MIP that I rightfully deserved and the second was a nonsense public intoxication charge that I received at Chilifest outside of college station. I blew a .094 and was released right after having my picture taken. I was never finger printed or brought to jail for either charge. My attorney is in the process of settling the PI case and the prosecutor has agreed to give me deferred and only pay $69 in court cost. I am tempted just to say fight it cause all I care about is getting my CHL and not having another alcohol charge on my record.
I know after two years I can get my MIP expunged which would take place in march 2012. Would that mean I would be eligible for my CHl. Thanks for the help. I need to figure this out soon though cause I need to let my attorney know what I want to do. Thanks again.

UPDATE:
I am officially done with my PI charge. I was able to get the PI charge dismissed and instead I was charged with littering which was dismissed after deferred adjudication. So all of my legal issues are taken care of. I have already turned in my online application, signed up to be fingerprinted, and enrolled in a CHL class. On the app I did not list any of my record cause I was never arrested and they are only Class C misdemeanors. The shop I'm taking the class through assured me that this was ok since I was never arrested, only cited. I'm just double checking that this is true or is my application going to be rejected? Welcome to the forum....Sounds like you should be fine. It probably would have been a good idea to call DPS and ask them if they wanted you to list those charges before you applied. But if I recall correctly, neither of those charges fall under 42.01 so they shouldn't disqualify you.

That MIP could come back and bite you. Juvinile records aren't sealed for CHL. I hope I'm wrong - - - but?

An MIP does not matter for a CHL since its a class C misdemeanor. It also happened when I was 19 so it will definitely show up.

I finished my class today. Scored a 250 on the shooting and a 96% on the written. My packet is in the mail. Hopefully everything goes through.
