Billy Bob's and TABC Signage

#1

Post by WickedOwl »

Short Version
If the TABC website lists an establishment as BLUE and they have RED signs posted, is it legal and/or advisable to carry there?

Long Version
The Mrs. and I are planning to attend a concert at Billy Bob's tonight and my initial suspicions were that the place would be a 51% location. Doing a little research on this site, I found a post mentioning they might be classified as a blue gun sign. Sure enough, as of 11:20AM 9/20/2011, the TABC database lists Billy Bob's Texas as blue.

The problem is, other posts mentioned seeing 51% signs at the entrance. If so, isn't the TABC database the official legal status, no matter what other TABC signs they post?

In other words, would you be comfortable walking past a 51% sign if you knew the place only had a blue license?
Also, has anyone been out there recently and seen what signs are posted?

If they are indeed a BLUE sign and there is no 30.06 sign, then I would have no problem carrying in. I have also read in a post on http://texas3006.com that there is a legal sign inside the door. I didn't check for signs the last time I was there back in June, I simply assumed it was 51% RED sign from other posts

If I check the TABC and it said the correct sign should be BLUE, I would carry. As long as I stay concealed, I legally carried.

Its been a couple of years since I was there but I seem to recall a RED 51% sign on the wall next to the ticket windows.

Billy Bob's is listed in the TABC database as a BLUE sign location and they have a FB (Food and Beverage) license, so no way they could be a 51% location, surprising as it is. And, the presence of a 51% sign does not make it off limits, only the type of liquor license they have and if they get over 51% of their revenue from alcohol sales.

And, http://www.texas3006.com" onclick="window.open(this.href);return false; shows them with a 51% sign, but no 30.06, so you would be legal to carry there. However, if found out you may have to prove that they are NOT a 51% location to the officers that want to arrest you. :banghead:

Keith B has the right outlook, and just worded it a little differently than I would. I was going to point out that the law does not forbid going where there is a sign posted, or even where they actually sell more than 51%. The loophole in the law is that it forbids carrying whre TABC has made a determination that sales are in excess of 51%.

And the license would be proof of the TABC determination.

If you like the venue, you can tell them they posted the wrong sign. If not, you can tell TABC.

Those who cannot remember the past are condemned to repeat it.
