What does DOC-Lang mean? I've never in my 40 years of my life ever heard of it; I assumed it was the type of ticket (DisOrderly Conduct). I just Googled it and there is not a single reference.

Charges filed on the security guard, school, district or employer of guard?

The best news would be that the charge was dropped and that badge heavy hot dog (the security guard) was looking for other employment.

I think the case will hinge on which "bad word" was used.

Like Steve Rothstein said, the language doesn't have to prompt an actual immediate breach of the peace, just "tend to". If it was one of the terms now commonly heard on primetime TV, you'll probably coast. Racial epithet? You're probably toast.

And, it will also matter what was written in the report. Did you admit to use of the term?

The most recent one is that video of the cops in Seattle who detained the wrong guy after a robbery report. (Granted the same law may not exist in Seattle, and of course there are more important issues about that event beyond language).

This like many other laws on the books is subject to abuse by those prone to do so. It does however have its uses. Example: people in a public area talking in a normal tone of voice but using extremely foul language without regard to families with children around them.

If the police officer didn’t witness the incident, and unless you admitted using the language, I would expect the security guard to have to show up in court as the witness (complaining party). Did the guard sign a complaint?

UPDATE


Just had the meeting between my lawyer and a Fort Bend Co ADA yesterday. Yes, it took Fort Bend County over 3 months to schedule it. After a 5 minute conversation between the ADA and my lawyer, the ticket was dismissed.

So its over and done!!

As my first run in with the law I would recomend ALWAYS get a laywer, even for something as minor as a Class C DOC-language ticket. She new exactly what to say and how to say it. I would never have had this dismissed without her help. The ADA didn't want to listen but the lawyer keeped at him until she got the dismissal we wanted. Yes I paid $350 for the lawyer to get out of a $180 fine, but it was worth it IMO.

No. You paid $350 for a lawyer to get out of a $180 fine and keep your concealed handgun license and avoid a 7 year revocation (which could have made it really hard to get approved for one again.)
