Eligibility after gun charge?
A close friend of mine wants to apply for a CHL, but he has an old gun charge on his record. In 1993 he was convicted of carrying a concealed unloaded weapon in Ohio. Would this prevent him from being eligible for a Texas CHL?

It was a felony and it was 17 years ago.

A felony will not only bar the felon from having a CHL, it would bar the felon from ever owning any firearm and this is everywhere in US, it is a Federal law.rlanicek wrote:It was a felony and it was 17 years ago.

Actually that is open to debate as 18 USC 921(a)(3) specifically excludes antique firearms. 18 USC 921(a)(16) defines antique firearms and includes replicas as such. I won't post the actual code as anyone who reads this now knows where to look if they want the details. Texas State law has similar provisions. Now I personally would not recommend depending on this to protect you from a conviction as I am unaware of what case law exists on the subject.Beiruty wrote:It is a firearm.
