AZ/FL CCW as a Texas resident, doable?

#1

Post by briggs »

Hello fellow CCW folks,

I have both AZ and FL CCW permits. I may be moving to Texas. Does anyone have definitive info regarding Texas residents carrying legally and without harrassment from LE with an out of state permit?

I renewed both permits earlier this year. I would just as soon not have to submit to another fee if I don't have to do so. And the application process is considerably more drawn out than than either of the permits I already have.

I have looked at the DPS site regarding CCW, but haven't seen the specific info I am looking for thus far.

I should think a Texas resident would have to obtain a TX CCW if they want to carry in TX, otherwise some folks may get a non-resident permit somewhere that doesn't require as much red tape as TX does.

Anyone got the skinny on this subject?

You can legally carry in Texas with a non-resident permit from another state. I am an instructor for both Texas and Utah. Lots of people get the Utah permit just to carry in Texas, and do not get a Texas permit for the reasons you mentioned, and some others.

If you met the requirements in another state, and they issued you a valid permit, and they also issue non-resident permits, then it will still be good in Texas. Just make sure that you have a valid address on the permit, and that it matches the address on your driver's license.

Regarding this, "Does anyone have definitive info regarding Texas residents carrying legally and without harrassment from LE with an out of state permit", if you don't act in a manner to get the attention of our LE folk, it is a moot point. Besides, just be sure you stop when you see this sign;

However, both of your permits are fine here; just be sure you know and obey Texas law.

To be very clear, you are saying that once I obtain a Texas driver's license, if I have the addresses changed on the CCW permits from AZ and FL to match the address on my TX DL I am good to go?

When you said "lots of people get the Utah permit just to carry in Texas", I am assuming you mean TX residents are getting the Utah permit to carry in Texas, instead of the TX permit. And that it is allowed by TX DPS.

HAh, txinvestigator! Love the sign!

As far as acting in manner that would draw the attention of the LE guys, not likely. I am a pretty quiet guy that minds his own business. But that is very good advice, thank you.

Well, I may be coming down to TX from northern AZ pretty soon to look around San Antonio to scout out a possible relocation, I shall study the TX carry and firearms laws so as to be prepared.

Thank you for the input.

You are welcome. I just checked and the Texas Legislature has updated their website to reflect the 2007 changes, so I have included links for you.

Texas Unlawful Carrying Weapons (UCW) law is the primary law that generally prohibits the carry of handguns and other weapons;

http://tlo2.tlc.state.tx.us/statutes/do ... m#46.02.00

Here is 46.15, or non-applicability. This tells you when UCW does not apply; you want section (b)

http://tlo2.tlc.state.tx.us/statutes/do ... m#46.15.00

Here are places your CHL does allow you to carry;

http://tlo2.tlc.state.tx.us/statutes/do ... #46.035.00

And places no firearms, illegal knives, etc can be carried ;

http://tlo2.tlc.state.tx.us/statutes/do ... m#46.03.00

our Trespass by a licesne holder law;

http://tlo2.tlc.state.tx.us/statutes/do ... m#30.06.00

misc laws;

http://tlo2.tlc.state.tx.us/statutes/do ... m#22.05.00

see #8 below;

http://tlo2.tlc.state.tx.us/statutes/do ... m#42.01.00

our self defense laws;

http://tlo2.tlc.state.tx.us/statutes/do ... tm#9.01.00

Welcome to Texas, hopefully.

Watson, I appreciate your clarification. This greatly simplifies the situation.

Txinvestigator, thank you for taking the time to provide the links, very informative.

I just finished reading the self defense sections, they certainly favor the law-abiding citizen in defense of self and property.

One item that may be of interest to others is that AZ doesn't put your address on the permit, just DOB, issue date, exp. date, sex, race, ht, wt, and eye color. If you change address you can phone, fax, or mail in the change without surrendering the permit itself or having it not in force. AZ also doesn't differentiate between resident or non-resident on the permit, it is the same for everyone.

What I did last time I moved within AZ is call the new address in one day, then called the next day to verify it was correct. This may turn out to be a handy thing if the TX relocation occurs.

Anyways, you fellas have been very helpful, great forum you have here. I will check back often.

Don't know @ your situation but I'm a TX resident and have a FL nonresident CCW. Got stopped over Tgiving in Orlando and presented both just to be sure. No problems, no questions and no ticket.
