But you would be wrong (and will be charged) in even attempting to purchase a firearm while on probation...

Actually a DWI first offense in Texas is a Class B misdemeanor. If that is his only offense (no prior felonies, other A or B misdemeanor's or DWI's) then he may be eligible to buy a gun, just not get a CHL until after 5 years with no other violations. Would have to know the whole history and exact charges to determine if he would possibly be kicked by NICS.stevie_d_64 wrote:DWI's are felonies if I recall correctly...

What I was trying to relay is that a DWI conviction (probation) first (Class B) or second offense (Class A) in Texas would not prohibit them by Federal law from purchasing a firearm if they had no other arrests, convictions or pending disqaulifiers. However, it DOES prevent them from a CHL for a 5 year period from conviction date with no further issues.
