Class B - 5 Years - ALMOST!

I was pulled over for DWI in February 2008. The DWI case was dropped down to an "Obstruction of Highway Charge" (OHC) which is still a class B misdemeanor. The date of disposition on the OHC is 10/15/2008. While I am aware that the guidelines state you are ineligible for 5 years with a class B, I was wondering if there was any leeway or leniency given depending on the charge and the fact that it has almost been the full five years. While it is not the end of the world for me to wait a few more months, I certainly would like to be able to obtain the CHL sooner. Any input would be appreciated.

Correct. My question was more directed at whether or not objectivity was involved in the application screening process. Wondering if any of you super experienced instructors and/or moderators might have seen any cases where a similar situation was granted a license in light of the fact.

No, the rules are the rules.
If they made an exception for you, then didn't make an exception for someone else, you are talking lawsuits, potential discrimination, and chaos.
You are almost out of the woods, be patient.

You mean where someone wasn't eligible and DPS issued a license even though they knew the applicant wasn't eligible? Not likely.

No leeway or special cases...
Pretty much everyone that deals with CCHs on a regular basis knows that Obstructing a Highway is a pled down DWI 1st. So I doubt even if there was consideration for the type of charge, that yours would work in your favor.

Good deal. I was pretty sure that was the case but can't hurt to ask! Thanks!
