Night time, the assumption is that an intruder is up to no good, and you cannot tell what weapons they have, shoot them.
if they are minors, thats no difference than someone 'of age'.
he is breaking into your car, how are you protecting yourself by "using" your gun?jareknyc wrote: can i use my gun to protect my self?
If you fear for your life, shoot, them but NEVER "try to shoot them in the leg, arm, shoulder, etc".jareknyc wrote:i fear for my life and shoot him in his leg???
If you ever use your weapon for defense your ONLY thing you try to do is STOP THEM. period. Dont ever say you tried to do this or that, other than "stop them".
there is no deadly force being used, therefore you cannot use deadly force against it.jareknyc wrote:trying to steal purse or wallet,
remember, even DRAWING your weapon is "using" deadly force.
If you feel they are in a deadly force situation, you can use your weapon to protect them, however, what if you were wrong?jareknyc wrote:but the person is getting hurt,
If you were wrong, they werent in a deadly force situation, then you are going to jail.
remember, with few exceptions, the weapon is only to be used in deadly force situations
The bold red letters are Incorrect, as defined by the law, if you are justified in using force production of a weapon to cause apprehension or belief that you will use deadly force if necessary is NOT deadly force, go back and read the law again, it was modified in 2009 to allow you to use the implied threat before actually using deadly force. Teamless you are also IMHO giving bad advice as to the other subjects too, the minor does NOT have to actually be there at night, nor does he have to have a weapon, but merely be in your home and be removing things as burglary of a habitation is considered by law as a violent crime, defense of real and moveable property also gives you the legal ability to shoot should the person breaking into your car be having goodies in his hands as he is unbutting your car. I do see that you are making your errors on the side of caution, but its too far.
