I thought it was up to the FFL if they wanted to do run a NICS check on an LTC holder?

It is... just as it is up to the LTC holder to be able to stop the transaction at that point and go elsewhere.

The rub here is that the OP did not have a LTC in hand... only an approved status on the web page, so the FFL was correct in running the check.

Nah, not yet... needing to jump through the slow FBI hoops (last time I'll ever, ever do this).

I've recognized that by being a little more patient, I would have avoided all this drama.

In many states it is the law that any weapon sold must have had an "example casing" pulled before sale. Connecticut and others do this. Glock does this voluntarily and many others do as well.
It's not many states, it is actually only a few that require that and they are finding that it isn't the great help in solving crimes they thought it would be.

Yes but they have to prove that you knew he was a felon. If you had no way of knowing how are they going to prove that? Give us some case law (preferably from Texas) where someone was convicted. Yeah, you can't get a subpoena for a 4473 that a private individual doesn't have a copy of, you get it for the FFL. And the ATF will get trace it for you without a subpoena.

Then you go to the address on it if it wasn't a ship's Fleet Post Office address or an apartment in another state, that you lived in 20 years ago. Then when you track down my current address and hassle me at home, I'll kick you out, and then you can go to see if you can get a magistrate or judge to sign a warrant for a paper that you know I don't have, and you can show up at my work, (in Maryland) where security will kick you out, and you can follow me up to Oklahoma in my car when I go to an Indian Reservation to gamble and drink and where the Tribal police will take away a Texas LEO gun just for giggles. :biggrinjester

Right and if LEO is state or local, the Feds and AUSA will tell them to pound sand, since not even the ATF is going to take a case that they are guaranteed to lose.

Just got the letter from the FBI telling me why they denied my purchase...

"This letter is in response to your inquiry concerning your NICS transaction identified above. A search resulting in a "deny" indicates the subject of the background check matches a prohibiting record containing a similar name and descriptive feature(s). The reason for denial is under the following prohibition:

[*]Title 18, United States Code, Section 922(g)(2): A person who is a fugitive from justice.

If you have not supplied this information and you wish to challenge the accuracy of the denial, you may submit certified court documents pertaining to the prohibiting record, or you may submit a set of your rolled fingerprints. A downloadable fingerprint card is available at <www.fbi.gov/nics-appeals> and may be submitted to the FBI Criminal Justice Information Services Division, National Instant Criminal Background Check System Section, Appeal Services Team, Post Office Box 4278, Clarksburg, West Virginia 26302-4278. The documents submitted will not be returned.

Pretty sure if I was a fugitive, I wouldn't have passed the LTC checks. So... hoops it is!

Going to go through with it anyway, and I'll post my result here. I can be pretty convincing to bureaucrats, having worked with them for over a decade, so I'll try to get in touch with the specific unit that would be able to have eyes on it. Either way, I'll post my results here.
