I can't even fathom what I would do in your situation. You certainly performed well, and you made the best possible out-come under the circumstances. The down side is, it isn't over...

IF you are lucky, maby he will be terminated by someone else during one of his other illegal activities.

People are complex, and not all subjects who behave as the aggressor in this post has go on to attempt homicide. Some have an epiphany along the way and recognize it's in their best interests to find something else to do. Others start a new unhealthy relationship which serves to focus their energy on it and they lose interest in former relationships. The reverse is also true - The reported end of one such relationship appears to have coincided with escalated activity here.

While it would be unwise to drop one's guard on the assumption that all will turn out well, in some cases it actually does. Only time will tell.

It sounds like you got a down right idiot on your hands. Maybe you should look into a lasergrip for your weapon. That way if you did have to pull it you might phsych this madman out.Statistics show that lasergrips can help prevent a violent confrontation form escalating into a shooting. Retired secret service agent Jay Bly puts it simply: ''Lasergrips help bad guys make informed decisions.'' Good luck buddy

I understand that but what that does is delay the inturder long enough to maybe allow the home owner to get in the house.
More importantly, it would establish entry without effective consent; i.e. burglary once he adds assault, and entering "unlawfully and with force" and therefore stacking up the justifications for force.

Most importantly, it effectively forces his hand early on; requiring him to either stop or commit an actionable offense so you can react appropriately before he finishes closing the distance.

It's also a distraction, and would tie up at least one of his hands momentarily if combat is already beginning.

To the OP.......I am glad you are ok.
You are very lucky. The Husband of a dear friend of mine was KILLED with a SINGLE PUNCH to the temple. A guy hit him and he was dead before he fell to the ground.
Your very much entitled to your opinion. I on the other hand beleive OC is a great choice in many situations.

I also believe that i would rather chance deploying OC and getting away coughing and burning, than to go toe to toe and risk further injury or death as you described. However, i dont think it takes rocket science to understand that OC will not be effective if youve got a windy situation and your downwind from your attacker. Hint: Common sense.

Am I the only one here who believes this CHL holder would have gone to jail if he had shot the guy?

I guess so. (well....yes I probably would have taken a ride for sure, but I firmly believe I would be in a defensible position regarding prosecution)

I have had an ENORMOUS number of conversations with the local PD, County Sheriff Dept, and the DA's office regarding this incident, and this person. Everyone has been of the opinion that it went well, could have been far worse, and that DF would have been justified considering the circumstances.

Bear in mind that in the months, weeks, and days leading up to this incident there were literally HUNDREDS of telephone, email, text, voice mail and verbal threats in person of death, aggravated assault, arson, and vandalism,...you name it. He even initiated an attempted physical confrontation in a grocery store parking lot when we were dropping off his daughter for visitation. I have reported EVERY incident, and have made EVERY reasonable attempt to keep law enforcement "in the loop".I have thoroughly covered my bases as being a "reasonable" person. I have even gone as far as contacting detectives, shift supervisors, and the SRO's at the middle schools when our daughter, and his new step-daughter have volleyball games at the same location. It is funny to see the look on his face when he walks in and my fiancee' and I are sitting chatting with the LEO's like we are old friends (which some are....and others are quickly becoming). "rlol"

To update....He has numerous charges pending in Denton County related to the harassment and assault. There have been warrants issued, but nothing they will go knocking on his door for. He has arraignments scheduled for early next month. We have also discovered throughout the process of straightening out my fiancee's finances that this guy has been collecting a substantial amount of money each month in his daughters name, earmarked for her "support". He has been hiding this money for years, and putting it up his nose, and blowing it in the casino's. Well.....as of months end, he will no longer be getting this money (approx 35% of his disability income) his daughter will. In addition SSA will be investigating him for fraud, and misappropriation of SSA benefits. He must sign affidavits each year to affirm that the money is being properly used, and each fraudulent document constitutes a separate felony..FEDERAL! We are waiting to find out if he can be charged for each separate check as well. When he discovers all of this is happening......he will undoubtedly hit the roof again.

This saga is nowhere near over.......stay tuned

I say that you did the right thing, ONLY BECAUSE YOU ARE STILL IN ONE PIECE TO TELL THE STORY. EX boyfriend situations are not good ones, I'm sure you know. Less than 48 hours ago, in houston, an EX walks up to a parked car and kills his ex and injures the new boyfriend. I TOO was a victim of the ex, being stronger than the ex only makes the coward in them come out and want to equalize the situation someway. Be careful and just cuz this time it ended ok, dont give him the benefit of the doubt next time. Maintain and protect yourself and personal space. My space was invaded from about twenty yards away, so I'm speaking from experience.

BE CAREFUL.
May 12th- Packet received via USPS confirmation
Sept 13th- Hurrican Ike
Sept 26 - waiting on Harris County background
Sept 30 - application completed- license issuance
Oct 6th - PLASTIC IN HAND!! (147 days of torture)

:iagree:

We are still dealing with this guy. We had court last week to modify his visitation (our petition) and to answer a contempt charge he made regarding the property that he declined to pick up (on more than one occasion....with LEO present). As anticipated, when he learned about his decrease in "pay"....he hit the roof. This led to another round of harassing calls, texts, and a few tense encounters around town. All has been tolerable so far.

In the hearings last week, he got his visitation revoked, 2 year protective order is now in place....and he didn't get the property. He pretty much had his posterior handed to him in the courtroom. Hearings for the 4 harassment counts and the assault charge are scheduled for early December. We have been in contact with the D.A. numerous times regarding these matters and have been informed they are going to insist on jail time for each charge. They are going to offer a less than maximum if he will plead guilty, but they will not take jail off the table. He will be given one shot to accept the deal, if not it will go to trial.

the saga continues........

The pressure on him is increasing, and the reality of where he stands is becoming increasingly hard to ignore. It is a sensitive time in these types of situations. He may elect to get real, deal with the charges, and move on with life, or he may decide to strike out at those he sees as having caused the mess he created and its consequences. There's no way I know of to predict which way it will go.

I know you don't need to be reminded not to let your guard down, but be especially watchful between now and the beginning of his incarceration, and during the time between his release and his settling into a new job / residence / relationship.

Roger That!

I have been keeping very close tabs on him. I (with a little help from my friends :thumbs2: )keep an eye on his comings and goings. He has gone back into that state that givers me that "calm before the storm" feeling. We have adjusted our daily lives to anticipate and/or accommodate his craziness.

All is good for now.......

Let's hope the calm continues.

I wish you the best in any case. You've already been through more rough times than anyone should have to put up with.

I hope you're recording all calls and saving any emails or text messages, as well as forwarding all of them to your attorney.

I don't know how your local PD (and Sheriff) handles such things, but on request in this type of situation, ours will arrange an escort from your vehicle to the courtroom so can stay armed until you have an armed officer with you. (Who also makes an excellent witness if anything less serious happens.)

This guy sounds like a nutcase that seems to think it ain't over til he says it's over.I would be concerned that he might one day go off the deep end and get a rifle and shoot you and your fiancee without warning.
It is said that if you line up all the cars in the world end-to-end, someone would be stupid enough to try to pass them
