I have a rugerLC 380 I bought new(in my wifes name), going to sell to a friend of mine who has a clean record , How can I get it out of my wifes name and into his . I typed up a sheet of paper with S/N and his name and DL number , but not sure if thats good enough . So if anyone has the correct/ Legal way to tranfer ownership please let me know .Thanks.

Why did your wife fill out the Form 4473 and go through the background check instead of you?

Because it was her gun , I had already gotten mine so since it was for her she did the background check

As long as your wife is okay with you selling her gun, you don't have to do anything. There is no registration in Texas and no requirement for individuals to do any paperwork to transfer ownership of a non NFA firearm. Since you're aware that this other person is not prohibited from owning a firearm all that has to happen is for them to give you an amount of money you are happy with and you give him the gun. That's it. Anything more you do to record the transaction is strictly for your peace of mind. IMHO

Agreed. You don't have to do anything. That said, if you really wanted to, you could go to an FFL, and have the buyer fill out a 4473.

If you're paranoid about being suspected of a crime being committed with that weapon I'd at least fill out that bill of sale, or just hold onto that 380.

Is your friend a Texas resident?

"Paranoid" is the correct term, because this is a scenario not worth worrying about. If the Bat-boys come calling on a firearms trace, all one needs to do is say "I sold the gun".

This is a KEY QUESTION.

Federal firearms law does not allow a private citizen to private citizen firearms transfer when the two people reside in different states. If your friend is not a Texas resident, a handgun sale must go through an FFL in the purchaser's home state. (A long gun sale must go through an FFL in either state unless the other state has state law forbidding it.)

Thanks I was wondering about this. I bought a gun from a relative whose name is on a gun shop's ledger somewhere along with the S/N. If I in turn sold the gun etc. etc. and it eventually was stolen and used in a crime, I suppose it might be useful to have a bill of sale with the buyer's name/signature and serial number on it?

Just because I'm paranoid, that doesn't mean they aren't out to get me!

It might be useful, but all that person is going to say is that they sold it to some guy.

I prefer no paperwork but if there's going to be paperwork I insist on it including the the serial number and denomination of the bills along with the serial number and caliber of the firearm. Just to be safe.
