Non CHL spouse travel question

#1

Post by magillapd »

My wife will be out of town this week for a confrence. I know that she can carry a loaded handgun in the car but is she allowed to also carry it into her hotel room for when she's in the room? I have about 10 million things going on now or I'd actually spend the time looking it up so I defer to you wise folks for the answer.

I told her if she'd just get her CHL it'd be a non issue but it's like talking to a wall when it comes to that... :grumble

Concealed is concealed, IMO. Leaving the gun in the room while she's away in conference is another question/issue altogether.

BTW, IANAL and HMMV.

Exceptions below should mean she's in the clear. I interpret both the hotel room and the vehicle as under your wife's control. And maybe your wallet but that's personal.
PC §46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:
(1) on the person's own premises or premises under the person's control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.
The spirit of resistance to government is so valuable on certain occasions, that I wish it to be always kept alive. It will often be exercised when wrong, but better so than not to be exercised at all. I like a little rebellion now and then. It is like a storm in the atmosphere. -Thomas Jefferson

I am not a lawyer...

But a hotel room would be considered an extension of your domicile, so she would be fine.

Additionally, the hotel should have a safe in the room or be able to provide her with a safety deposit box on premise for storage.

YMMV

My son's ex-MIL carries three handguns when she's driving around:

One in the console, one in her purse, and one somewhere on her person (I didn't ask about the specific location :evil2: )

But yeah, she has her CHL.
