A friend of mine is in need of some really sound legal advice... As he (my friend) was driving home this evening, he (my friend) noticed two vehicles in front of him. One of the vehicles was in a late model truck like his. As time went by the traffic came closer to the two vehicles. he (my friend) was unfortunate enough to be positioned right behind the vehicle that was being toyed with. The driver came to an abrupt halt in the middle of the fast lane on Hwy 6 in Manvel. He then got out of his vehicle with something in his hand that he (my friend) did not fully recognize what it was. He (my friend) went into defense mode and jumped out of his truck still standing behind his door with his firearm pointed at this mans chest. He (my friend) told him that he (my friend) would shoot him where he stands and that he (my friend) was not the person that he thought he (my friend) was. He (my friend) then pointed to the other vehicle pulling away from the spot that they were at. He got back into his vehicle and drove away. My question is, should he (my friend) call the local police and make a report on this or not? HELP!!!

From your description of the incident, I get that there were two vehicles in front of yours. I think that one was messing with the other. Not sure whether one was tailgating the other, driving aggressively, cutting the other off, or what.

Then, at some point, the guy who was being messed with got your vehicle confused with the guy who was messing with him. I got it that your vehicle closely resembled the vehicle of the guy who was driving aggressively and messing with the other guy.

After that, it is not clear who did what. I can't always tell who "he" is in your description of events. Try explaining again with fewer "he"'s and more usages like "my friend" and "the guy being toyed with", and "the guy driving aggressively" or something like that.

Were you with your friend when all this happened?

Finally, IANAL, and couldn't give you legal advice if I wanted to.

Why would he say this? What lead him (your friend) to believe that he (your friend) was not the person he (the guy from the car) thought he was?

Did he (your friend) ever recognize what the other person had in his hand?

No he did not identify what he had in his hand but it be safe to say if someone stops thier vehicle in traffic in a busy street and jumps out with something in thier hand coming towards him he was right in defending himself or stopping the threat

The guy stopped in the middle of the highway and approached the friend's vehicle with what may or may not have been a weapon. The supposition can be made that the guy who stopped thought the friend was in the vehicle that had been messing with him.

Since the friend didn't know what the other guy had in his hand, he assumed it could be a weapon/

I know the suppositions or assumptions, I am asking for more details of what actually happened. What "the friend" actually saw or thought, could be used to determine whether "the friend" was justified.

Now on a serious note,
You asked if your friend should of called the cops and report what went down.
IMHO, yes.
If your friend was seen by others, they would more than likely call the cops and report seeing a man point a gun at another man.
And probably given a description and maybe a plate number.
Wouldn't look to good in the cops eyes that your friend didn't call to make a report himself.

So, vehicle A and B were messing with each other. Vehicle A stopped in the middle of the road and the driver of Vehicle A approached Vehicle C. The driver of Vehicle C assumed his truck might be a victim of mistaken identity since Vehicle C looks like Vehicle B. The driver of Vehicle C drew on the driver of Vehicle A and gave a verbal warning. End of story. Am I right?

Either way, the driver of Vehicle C should've called it in. He'll be in a tough spot if the driver of Vehicle A or Vehicle B call in a "man with a gun" and point to the driver of Vehicle C.

I also had to draw my weapon due to someone trying to get in my truck with me. The first thing I did when I got away was call 911 and gave a brief description of the altercation and offered any info they needed. I did this to cover my tail and show that I was not trying to hide anything in the event that the BG called them too....he did...his responding LEO called me for my side of the story and told me to have a good day.

So to answer your question....if I were him (your friend) I would have called 911 and explain what happened. If someone else called in with your friends tag number, LEO could be looking for him thinking your friend is the BG.

This was almost as confusing to me (at first) as that "I saved the little old lady by shooting three BGs at pharmacy" story... What ever happened to that guy anyway?
