ATASCOSA COUNTY, Texas – A business owner shot and killed a suspected robber near Poteet according to deputies.

The Atascosa Co. Sheriff’s investigators say around midnight two robbers burst into Larry's Game Hall on Hwy 16. That’s about seven miles north of Poteet.

The robbers, who had a shotgun and pistol, fired one shot in the ceiling and began demanding money. They forced a female worker to ground and pointed shotgun at her. The business owner came out of the backroom with a 40-caliber handgun and shot one of the robbers in the head.

The 25-year-old man died at the scene. The other would-be robber ran off. Both are believed to be from the Atascosa area.

Right now, investigators are notifying the family of the dead suspect and are working on an arrest warrant for the other alleged hijacker. Both the Atascosa Sheriff’s Office and Texas Rangers are handling the investigation.

Here's some proof that you don't always need a .45 to get the job done!

The lawman added that it appears the business was running an illegal operation involving slot-type machines called eight-liners and will be shut down in the next couple of days.

I wonder how this will look to the grand jury?

Criminals like to rob other criminals since they feel the victims might not report the crime.

Even though the business of running the gambling machines was illegal the owner still
had the right to have a handgun on his premises <unless he was a convicted felon?>.

It would seem that although the owner was running an illegal business he still has the
right to protect his employee's life as well as his own.

He'll be in enough trouble for the illegal enterprise charges. I would think the grand
jury will "no bill" him for the shooting.

Here's a side question:
Felons aren't supposed to be in possession of weapons.
But are felons allowed to have weapons in their residences, businesses, and
vehicles? Or just prevented from getting CHL's?

Federal law prohibits a person convicted of a crime "punishable by imprisonment for a term exceeding one year" from possessing a firearm. No exception is made for having a firearm at the home, no matter how long ago the conviction.

It was then that business owner Larry Horn walks out of the back room with a .40-caliber semi-automatic weapon, startling the robbers, according to the chief deputy.

Soward said the robber with the shotgun turns to aim at Horn, but that the business owner fires first, striking the man in the head and killing him instantly. The other suspect then runs out the door.

“We think we know the identity of both of them,” Soward said, adding he's awaiting fingerprint confirmation on the dead gunmen before releasing his name.

He said no customers were inside the business when the robbery occurred and that the employee wasn't hurt.

“Horn was brought in for questioning and we took a statement from him, but we don't anticipate any charges at this time,” Soward said.

Yes, sir... very good shooting! He evidently was well prepared for a robbery, had a plan and executed it to perfection.

I can only hope and pray that "if" I ever found myself in a life and death situation that I will know what I need to do and not to hesitate. Carry out my plan enthusiastically and forcefully... the one that acts first, usually wins. :thumbs2:
