Hypothetical situation:
If you are in your car or walking, and suddenly riots break out, and you or your car is attacked by multiple rioters, can the victim use lethal force? What would be so considered self defense? Are there any cases where this has occurred? Would it be justified?
In my opinion, my car becomes my best weapon. If I am able to drive, in any direction to escape, that's what I will do, if rioters get injured because of this, I'll take my chances in court. If I am walking and I am attacked by a group of people (Texas law defines a riot as a group of 7 or more) Then my gun is out as I extricate myself, if I have to use deadly force, again, I'll take my chances in court.
This has occurred, in LA after the Rodney King trial verdict, rioters attacked motorists, including a truck driver, pulled them from their vehicles and beat them. Stay in your car, it is your best weapon, no one is strong enough to stop a moving vehicle.JMHO
What he said.
Your 3500-4000 lb vehicle is a much more lethal weapon than your handgun. Put it in gear, tromp on the accelerator, and get away. When people are climbing on your car and trying to shatter your windows to get at you, they are no longer innocent pedestrians, and they lose any legal protections they had. The flip side of this is, AS SOON AS YOU ARE CLEAR,
STOP running over human speed bumps and make a conscientious effort to not hit anyone unnecessarily as you continue to escape the situation.
edited to add:
I lived in the Los Angeles area during the Rodney King riots, and it swirled around the building I worked in. We had armed National Guard patrols in the immediate area of our offices. Buildings were even burned in Pasadena, where I lived. The scope of the riot was HUGE.....like it filled the entire Los Angeles area sky with dense acrid smoke for days. I watched
Reginald Denny getting dragged out of his truck and beat near to death, in real time, as I watched. That happened right near the main post office our company dealt with. The riot came within a couple of blocks of a dear friend's house. I was standing in his office when he phoned his wife at home, told her to get the AK out of the closet, and to not let anyone through that door until he got home.....kill them if necessary.
Never again. I will never allow myself to be caught in that kind of situation. I will run over anyone who tries to stop my vehicle and drag me out of it, and I won't even look back.
