I was just contacted by a group who attended a CHL class approximately two months ago. They are all getting notifications back from the DPS rejecting their CHL-100 due to the fact that the instructor's certification is expired. They are asking me for advice, so I am attempting to research possible solutions.

I have looked in the Admin rules and cannot find this issue specifically addressed. If the instructor renews, can he then re-issue the CHL-100 or will the class have to be in effect re-done?

I advised them that the only thing I could do would be do the class over...completely, as though it never happened. I also advised I would have to charge due to my expenses of printing, renting the classroom, and range. I feel their pain, but I cannot afford to lose money on the deal.

:iagree: I con't find any difference in the law between a CHL-100 from an expired instructor and taking a class from a fake instructor.

Has the expired instructor at least refunded their money? If not, it seems like they could go after him for fraud.

I am sure that it was an honest mistake and there was no intent to defraud anyone. I can see where someone would forget that their instructor certificate is a two year renewal expiring on Dec. 31st, vs their CHL expiring on their birthday.

Anyway, I have been totally unsuccessful in finding any words on the website or in the Admin rules addressing this. I suspect they are stuck with a do-over. I was hoping that it was as simple as a re-issue of the CHL-100 after the renewal process was complete.

They have to take a new class over again. I know this for fact.

That question was asked during my class by someone who's business partner couldn't make the class for one reason or another. The answer was very specific - while you're in expired status you can not do any classes or range qualifications, period. And if you did something while you were expired, it would have to be re-done.

:iagree: That's the only way to fix this problem even if the expired instructor renews he can't issue another 100 without he gives the class to these folks again.

Back when the instructors certificate expired every 2 years on the anniversary of the instructor's renewal class (instead of 12/31, like now). I had a friend whose instructor's cert expired in Sept, he taught a class in Oct but did not take HIS renewal class until Nov. He had to reteach that class and re-shoot all the students. :(

I cannot imagine an instructor not knowing his cert expires. Any instructor worth having a cert will monitor the legislature every other year. He should know that new gun laws go into effect 9/1 following and he will have to take a renewal instructor class (or do the online version this cycle :) ) by 12/31.

I wonder if they even know about the requirement to have NRA or other national instructor certification to renew.

My neighbor, who is also a chl inst., has been teaching on an expired license and then when his students are getting letters back from DPS he is refusing to refund money. I find this highly immoral. Even if it was an accidental oversight (which I find hard to believe). Another of my CHL friends has written a letter and turned him in to DPS. What urks me even more is when I started teaching he gave me all sorts of grief and issues since I lived so close he felt I was impeding on "his" territory.
