If the physical evidence supports the BG breaking her window while she is still in the driver's seat, can't say I wouldn't have done the same thing. Probably would have shot him too.

Who is to say it wasn't a bump and rob? Or a bump, kidnap,and rape.

Note that no CHL would have been required in this situation.

Sounds very similar to the very first CHL homicide in Dallas. Which was ruled justifiable. And in this situation, it's a similar dynamic of disparity of force (male aggressor, female CHL/victim).

That said, some facts are missing in these reports, like
- Was her window broken?
- Who hit who (with their car)?

Kind of irrelevant, IMNSHO. Obviously the deranged male was showing his true colors and got what he deserved. She done good. The drives to and from work will be more pleasant for some folks now that he is no longer a contributor to the mess.

Gun laws such as we have in Texas do indeed allow for easier thinning of the worst from the herd, which has no doubt prevented others from becoming victims.

Pulling in the gas station may play into her favor if her story it true. Those places are littered with cameras and if the guy was haveing a rage fit on her car and it's all caught on camera, that should help her self defence case. I'd be very interested in see the video from that day.

Also, staying inside the vehicle is a smart move, as it adds Castle Doctrine to the mix and provides a clearer definition of threat, ie, forcibly entering the vehicle, and for those without a CHL precludes that requirement.

As I see it, this incident was the legal equivalent of waiting for an intruder to go through a door or window before shooting.

There is a good chance the gas station has security cameras, so they should tell the story if in view of one of them.

I came here to post this story too...

In the link i have, there is a witness who said the man who was shot was not doing anything to threaten the lady in the car.

The witness says he would have seen or heard any rage or threats that the man would have shown to her.

Perhaps she should have driven away first, assuming she wasn't blocked in.

The cameras should show what happened. Until and if they video comes out we will just all have to wait.
