Not much info to go on here but she appears the aggressor. Can he say he was in fear for his life?

I'm not saying what he did was right, but...

I understand.

Unless there was weapon presented by that lady, were is the justification for deadly force?
Did she came with swinging a bat? How did she destroyed the car windows?

Messing with a man's ride is justification right? IANAL though.

Seriously, if she was busting windows, she was armed.

Any implement capable of breaking vehicle windows is also capable of inflicting serious or fatal brain injury.

Anyone breaks out a window of my vehicle while I am in it will need to be stopped.

Yeah, but it's a lot easier to justify using deadly force if the assailant is unknown to you and so in breaking out your window likely has robbery or car-jacking in mind. If it's your ex-girlfriend her motive is less certain, especially to a jury (maybe she was just mad and all she was doing was vandalizing the car), and you're facing a significant probability of going to prison. For one thing, you'd have personal information to form your decision, and that could well work against you. For instance, if she owned guns and you knew --like you'd gone to a range with her shooting-- you might be facing a prosecutor saying that she was only out to vandalize your car since she brought a bat instead of a gun, so you "knew" she wasn't trying to kill you.

I heard that the car's windows where smashed, a day earlier. Not at the same time when she was shot.

The article clearly says the windows were broken the day before...
The reporter also says the same...

Unless the woman presented some other kind of deadly force threat immediately prior to the shooting, that guy will be spending a long time in jail.
Neighbors said the couple argued often, and on Sunday, the woman involved smashed all the windows in her ex-boyfriend's van.
Shooting happened Monday at his work.

Was that sarcasm or did you really intend to infer that sometimes a guy just needs to pull the trigger without legal justification.? :confused5
Maybe I am misreading your post...
