I think he will be found guilty, but even if he is not, he will not make it through the civil suit filed by the family and the survivors.

If he is acquitted, there might be a civil suit, but I don't think it will go anywhere due to the Castle Law. After all, that's basically his defense, right?

You know, everyone has been talking about the CHL on trial.

Let's talk for a minute about Kelly Danaher, the teacher who was shot and killed.

Just as an aside, I would not want that teacher teaching my children. Charging a man you know has a gun and who stated he will shoot you if you approach him . . . not too smart. Not saying I am sympathetic to the CHL on trial, but I am also not sympathetic to the teacher. Water finds its level, drunk and stupid reaps what it sows.

The other lesson here is if someone is telling you they have a gun and they will shoot you if you don't leave them alone, then LEAVE THEM ALONE and go away as quickly as possible! "Why is that snake making a sound like a baby's rattle? I think I will play with it!"

Jumping,

Rodriguez was the instigator and was on Danaher's property with a gun and a camera! Rodriguez had every intention of shooting the guy at the first excuse! Witnesses have said repeatedly that no one threatened Rodriguez!

In addition, Danaher may have been intoxicated; being that he was celebrating on his own property! Some make poor choices while intoxicated. But we know where the poorest of choice may have begun.

Got to say if Rodriguez was on Danaher's property uninvited and pulled his gun at the get go he is th only person that had broke a law above a noise violation citation. Youth, testosterone, and booze is a recipe for grief. The party goers were invincible and Rodriguez was under the impression he was much smarter than he actually was. Trespasser with gun shoots home owner in his own driveway along with two others claims self defense under castle doctrine. His tape should convict him all by itself. Insanity defense would have made more sense.

So what?

That is true. But Danaher is still dead when he could have chosen to walk away instead.

It was still stupid of Danaher to charge at someone who said he was going to shoot him.

If a person has a gun drawn on me and tells me not to come any closer, I am going to believe them and act accordingly. (In my case, "acting accordingly" may include shooting them . . . )

Danaher was getting drunk where he should have gotten drunk. At his home.

Rodriguez came into Danaher's Castle and claimed "Castle Doctrine"?

Unfortunately for all involved, this should have been a matter for the local LEO's to handle.

I have absolutely no sympathy for Rodriguez.

Most of the time when people are calling something a "conspiracy theory" it is just a method of ridicule used to suppress debate. But no conspiracy theory need be advanced to explain the behavior of the MSM. Is it a "conspiracy" that most of the Democrats who voted in the last presidential election voted for Obama? Did they get orders from the top conspirators to go out and vote for Obama? No, they became Democrats because they believe people like Obama share their political vision, or at least, do so more than the other alternative. The MSM is mostly made up of left-wing political activists who joined because they see media positions as a means of advancing their agendas; and since they mostly share the same political "vision" and agenda, especially on key issues like gun control, they cast their "votes" for that agenda whenever the opportunity arises, just like Democrats vote Democratic, and Republicans vote Republican.

It's obvious that the MSM operates in unison on many issues, including gun control and support for The One, and to pretend otherwise is bordering on the delusional. No orchestration is necessary for this to happen --though I do think there is some degree of orchestration via the Obama administration, especially in their political coverage, but I don't think it comes in the form of orders being passed down from the top, but more in the form of "editorial expression." More like a dog trying to please his master than a soldier carrying out his orders.

He did a lot of damage to the 99.9% of us who do the right thing with our CHL. I hope the politicans see that.
