It became "setting a trap" when they told a witness that they were setting a trap. IOW, it wouldn't have been if they hadn't expressly said so themselves.CowboyEngineer wrote:If leaving your garage door up and having an alarm system is considered setting a trap, then I am in big trouble. I don't know if the kid deserved to be shot but if you are shopping in someone else's garage at night you shouldn't expect a hug. Whether the kid was a homegrown thief or a foreign exchange thief doesn't matter to me. My sympathy is with the shooter.

Re: German Penal Law Applies in Montana Shooting???
I don't disagree, but I do think expressing the desire to shoot someone before the fact, then setting a trap and doing it, isn't going to play well with a lot of people, and isn't a particularly smart move. OTOH, you should be able to leave a purse in your own open garage without someone stealing it, and it's a thin line between baiting and just leaving a purse in your garage. He might be OK if he hadn't professed his intention to shoot someone before the fact, and didn't saying anything about using bait.gigag04 wrote:Seems like a self correcting problem with purse thieves...or maybe I'm missing something.
I don't advocate the means...but still.

Well, turns out, whatever the Germans think, it doesn't look like a good shoot.

Apparently this guy and his gf set a trap with bait....wired their garage with motion sensors and video.....and left the garage door open with the gf's purse as bait after telling a witness he waited up at night to shoot burglars. He probably won't fare well with a jury even in Montana.

Re: German Penal Law Applies in Montana Shooting???
It is not only outrageous political supplication, but complete hogwash. How was the home owner supposed to know the intruder was a German citizen or what German law is? Nothing in US law requires us to identify the country of origin of an attacker before using deadly force. Better watch out for this becoming any kind of precedent, since prosecuting this guy because of German law and citizenship will give illegals from Latin American a free pass for burglary and assault. This is a sovereign nation, the German citizen came here subject to OUR laws. He assumed all risks of violating US law, just like a US citizen in Germany assumes the risk of violating German law.
