If a LEO draws his sidearm and doesn't have to use it, he just reholsters and that's the end of the matter. A non-LEO could face a charge of intentional failure to conceal or even deadly conduct if the justification is questionable.

In this case, with an armed robber in flagrante delicto, I think there would be no question. If it's a case of two guys walking behind you at night and whispering, not so much.

Re: CHLer shootout with burger king robber

Welcome to the forum, beccasgrandpa.

I want to point out this record as reported by the Miami Herald:
...selling cocaine and marijuana, aggravated battery with a deadly weapon, resisting an officer with violence and carjacking. In all, he had been arrested more than a dozen times. His run-ins with the law began when he was 15. ... burglary ... battery ... aggravated battery and assault with a weapon and assault on a law enforcement officer.... burglary, kidnapping and strong arm robbery.
I don't know why this man turned out this way. I don't care to speculate. But according to these reports, he had no respect for the law or human life.

Contrast that with a man who has worked within the system, obeyed the law, and worries about lawsuits and prosecution.

Which will be quicker to pull the trigger?

No, you don't.

You have to be 21 or older to buy a handgun from an FFL or to buy handgun ammunition. It is not illegal for a person who is 18 to 20 to possess a handgun.

I doubt Florida makes it illegal for 18 to 20-year-olds. Their laws are similar to ours.

The guy was apparently convicted of felonies as a juvenile (I know juvenile courts use different language). It was illegal for him to possess a firearm or ammunition on that basis.

The question that the antis refuse to answer is why this guy was not in prison after multiple convictions for violent felonies.

Re: CHLer shootout with burger king robber

He was 18 years old, so he couldn't legally buy .380 ammo. He probably had to take whatever the local bootlegger was selling.

Wadcutters can do quite a bit of damage in .380, and they feed better more reliably than HP in some pistols.

I suspect that criminals don't know all that much about firearms, especially the young ones. Most are semi-literate, and they probably don't know many adults who have real knowledge.

Re: CHLer shootout with burger king robber

A lot more "economy" pistols in 1994.

Remember, this may not be a representative sample. It's something like ten thousand weapons seized from among millions that may be in circulation among criminals. Maybe only the least competent criminals use cheap roscoes.

Re: CHLer shootout with burger king robber

Here is the TIME article that that was referred to from 2002:
http://www.time.com/time/nation/article ... 83,00.html" onclick="window.open(this.href);return false;

The reporter probably just googled "Bryco 380." That how I found it.

The Bryco .380 is #9 on the list. Many of the others are quite respectable and more expensive firearms.
