Jan 24th Paperwork Mailed
Feb 10th Paperwork received by DPS

PIN - Never got letter

May 11th Email asking for PIN
May 15th Received email with PIN
May 15th Status - Error, No application
May 15th Called - Informed it takes 24 hours for the web to be updated
May 20th Processing Application
Multiple emails sent including to State Rep and to State Senator
Aug 14th Status updated - Application Completed - license issued or certificate active

GF got call from DPS.
Delay is now the ... Background Check - Brazoria County.

Day 155

BTW friend just got his plastic yesterday, DPS received his packet in November - No issues on his app 7 months...

I understand the backlog and the commissioned officer issues.
Is the department waiting on any other information other than
the Background Check?

Is it the Harris County or Brazoria County check that is delayed?

Is there an estimated date of completion for the application?

Starting to come to light...
They don't have enough commissioned LEO's...

Just want to let you know that I have sent a e-mail to the Department of
Public Safety asking someone to please check the status of your
application and to give me a call. Just to let you know. DPS was
beginning to see a slow-down about a month ago and for some unknown
reason they are once again seeing a large spike in new applications. The
problem is the security clearance. A commissioned officer is the only
one that can run a background check.
I will let you know as soon as I
get a call-back.

Quicker response than I expected, and I have to give Mrs. Brummet credit, she is taking this one personal.

The increase of applications has prompted the Department to work
on a plan of action. Your application is waiting on the required
background investigation to be completed. You have not been denied, so
there will be no need to start the process over. That part of the law
that you are referring to pertains to criminal files requiring
additional documentation or processing. I have requested that your
information be forwarded to my attention, once I receive the complete
application I will contact you. Thank you for your continued patience.

I miss quoted the 90 days its actually 60 days kind of
Bellow is the Statute
It states that the Department has 60 days to issue or reject or request more time
if they do not do the above 3 within 30 days after the 60th day then its is denied.

However, I think we now have a good bit of "Written Proof" that it is not an auto denial.

411.177
(b) The department shall, not later than the 60th day after the date
of the receipt by the director's designee of the completed application
materials
:
(1) issue the license;
(2) notify the applicant in writing that the application was denied:
(A) on the grounds that the applicant failed to qualify under the
criteria listed in Section 411.172;
(B) based on the affidavit of the director's designee submitted
to the department under Section 411.176(b); or
(C) based on the affidavit of the qualified handgun instructor
submitted to the department under Section 411.189(c); or
(3) notify the applicant in writing that the department is unable to
make a determination regarding the issuance or denial of a license to
the applicant within the 60-day period prescribed by this subsection
and include in that notification an explanation of the reason for the
inability and an estimation of the amount of time the department will
need to make the determination.

(c) Failure of the department to issue or deny a license for a period
of more than 30 days after the department is required to act under
Subsection (b) constitutes denial.

Latest poke in the eye we gave the DPS, they are starting to really get us PO'd
Sent to our Rep, Senator, and to Rick Perry, and a few Right Wing media friends we have in Harris county and Austin...

Mrs. Brummett;
I understand that the Department has had an increase in the number of applications since November, however I am concerned about the amount of time it has taken so far. As of today (5-29-2009) it has been 108 days. Will the department now require me to start over since the license has not been issued within the 90 days as required by the Statutes?

From discussions with other applicants this seems to be a common issue with the department and I am not an isolated case.

This seems to be a State wide issue and not just a "Hurricane Ike" issue.

Is the delay being caused by internal issues such as internal strife, under staffing, directive from a superior, or a condition set by the FED as part of the stimulus package?

What is the average process time you are seeing applications take when there are no issues, questions, or problems with the application or the background check?

I will expect your reply by close of business today.

Its harris county.
DPS called my GF yesterday. Told her that they are waiting on Harris County for the BGC.

So the next letter going to our Senator and Rep will be complaining about Harris County.
Also folks keep in mind the FBI are jammed up from nationwide increase in requests.

Does the obamanation have his foot on the brakes over at the fed?

Dear Representative Bonnen;

I'm sure that I am not the first person to come to you about the extraordinary
delays being encountered by Texas citizens who are trying to obtain a
CHL. Today, I confirmed with the DPS they received my application in
excess of 80 days ago. I received my Pin number on 4/21/09 during my weekly email
request for information. At this time the DPS website shows my
application as processing. Could you please contact the DPS and ask them what the
general holdup is on the application processing that everyone is
complaining about. And assist in insuring that the department be held accountable for following
the same laws we are more than happy to comply with.
