Well guys, I received my CHL in the mailbox today. :grin: So, from DPS receipt of application up to today marks 87 calendar days from mailbox to mailbox.

Congratulations there fire. You were one of the very fortunate souls to have such a short wait time. I also have great news and that is as of today the DPS website says that my application is completed and license issued! :grin: My wait time was a total of 85 days. :???: Im assuming it will be a few more days before the license actually arrives in the mail.

I have a question for you guys (and gals). Im hoping that Charles or any DPS instructors like txinvestigator might clarify by chiming in on this one.

My wife and I are moving at the end of this month. When we move, I will obviously have to have both my DL and CHL renewed with the new address. Will I be able to carry while waiting for the updated CHL? I see no specific reference to this in statute GC 411.181 Notice of Change of Address or Name Thanks in advance.

Wishing better wait times for everyone.

DPS, when reading the statutes, technically has up to 90 days to process a CHL. It's dependent upon how long they sat on an application before sending it over to the "director's designee" in your area for checks. Nasty little loophole. Day 79 for me........

I know, I know. I stated in my last post on this thread that I wouldnt say anything else until I received my CHL. Well, I am a man of my word, but after seeing dubya's post I felt a change of heart.

Heh, it's nice to see that I'm not annoying everyone with my ranting and that it is actually helping in terms of my waiting time giving something to measure against. ;-)

Aggie Dad, you and I are about 2 days apart from each other in terms of when our applications were received by DPS. It'll be interesting to see who gets their CHL first. ;-)

Hope everyone is doing well. This forum seems to posess a very friendly and informative lot and for that I am thankful.

Is it just me or does it seem like women are getting their CHL's much faster than men? This is something like the 3rd post I've read of such being the case. Furthermore, jbenat states that he and his wife sent in their apps. on Jan. 2nd. Excuse me? Jan. 2nd, 2006? And your wife already has her CHL? My app. was received by DPS on Dec. 12, 2005 and Im still at "processing application". My record is spotless as far as I'm concerned, all the way down to excellent credit history. Is it time to call an attorney?!? Or should I just preach to the choir. :nopity
This is absolutely absurd. :banghead: Yeah, I know Ill get my CHL eventually, but it wont seem like sweet justice after this ridiculous wait time. And yeah I know, Geopagus now sounds like a broken record. Once again, I digress and wont post on this particular thread anymore till I receive that elusive CHL. Day 76 and counting............... :headscratch

Found this by a gentleman over at packing.org. Thought it might help clarify as to why some people are delayed or believe they are delayed in receiving their CHL's. Very good and informative post, if it holds water. Of course, I'm still waiting at around calandar day 70 or something to that effect.
This is the common understanding, based on the somewhat confusing way the code is written. I to thought it to be this way until I took the time to investigate it in depth following the problems encountered with my wife's application this past year. After 60+ days of and no response, she contacted the DPS and was told her app had been approved, however, the girl handling her app was "really busy", but assured her it would be issued that day. A second call a few days later was met with "we are not sure why it was not issued, but it shows to have been approved several weeks ago. After another week, I became involved and spoke to a supervisor. To her credit, she did get the license issued that day along with an apology, but during our discussion she was able to point out a few facts in the code that, like most, I had missed or misread.

The code in question is the Texas Government Code, sections 411.176 REVIEW OF APPLICATION MATERIALS and 411.177 ISSUANCE OR DENIAL OF LICENSE. For full understanding, one should read the entire text, however, for the sake of time, I will only include the pertinent areas.

Section 411.176 (a) states: .....Not later than the 30th day after the date the department receives the application materials, the department shall forward the materials to the director's designee in the geographical area of the applicant's residence so that the designee may conduct the investigation described by Subsection (b). .....

(b) .....The scope of the record check and the investigation are at the sole discretion of the department, except that the director's designee shall complete the record check and investigation not later than the 60th day after the date the department receives the application materials. .....

Section 411.177 (b) states: .....The department shall, not later than the 60th day after the date of the receipt by the director's designee of the completed application materials:
(1) issue the license
(2) notify the applicant in writing that the
application was denied:
(A) on the grounds that the applicant failed to
qualify under the criteria listed in Section 411.172;
(B) based on the affidavit of the director's
designee submitted to the department under Section 411.176(b); or
(C) based on the affidavit of the qualified
handgun instructor submitted to the department under Section 411.189(c); or
(3) notify the applicant in writing that the department is unable to make a determination regarding the issuance or denial of a license to the applicant within the 60-day period prescribed by this subsection and include in that notification an explanation of the reason for the inability and an estimation of the amount of time the department will need to make the determination. .....

Section 411.177 (c) states: Failure of the department to issue or deny a license for a period of more than 30 days after the department is required to act under Subsection (b) constitutes denial.


So, to review the facts of the above information, the DPS has 30 days from receipt of a completed packet to send it to the director's local designee. (In other words, they can actually sit on it for the first 30 days.) The local designee then has 60 days from the time the packet was originally received by the DPS to review it and send it back to the DPS. (Note that it says received by DPS, not the designee, this insures that the designee has at least 30 days to review the packet and send it back to the DPS. This now accounts for a total of 60 days from the receipt of the packet by the DPS. ) Once the DPS receives the packet back from the local designee, the DPS has 60 days from the time it is received by the local designee in which to process the packet and act on it. (Note that it says from the time received by the local designee, not the DPS, this insures that the DPS has at least 30 days for final processing of the packet. This now accounts for a total of 90 days from the original receipt of the packet by the DPS.)

It is also stated that if they do not act within 30 day after these time lines, the app is considered denied.

Therefore, if you add up these numbers, you will see that the DPS actually has a total of 90 days to act on your application and it is determined denied only after 120 days of inactivity. It also allows the DPS to extend this time to a total of 180 days if there is reasonable cause to suspect there exist some disqualifying event, but only with proper notification within the original 90 days (actually 120 days if you consider the 30 day grace before assumed denial).

It is a bit confusing when you read it, and as the supervisor admitted to me, they do try to complete the process within 60 day of the receipt of a completed packet, however, they actually have 90 days to act, and if you read the code carefully, you will see this is actually what is stated.

No doubt, the process is in need of help...from the local level right up through the federal. I'm sure the folks in Austin get delayed waiting on information from other agencies. It can't be a lot of fun responding to questions about things that are out of your control.

I agree to a point. I'm going to leave the process alone now that I've gotten in touch with them. I am thankful for the timely responses from DPS. However, one thing is certain, which is that there's still a 60 day statute. It's sort of like me saying, "well the speed limit in the city according to law is 60 mph, but I'm in a hurry today, so Ill go 72 mph." Is the law going to care? They may give me a break and they may not. The point is that I broke the law by speeding and shouldnt expect any breaks should I get caught breaking it. There has to be more accountability somewhere IMHO. Thanks for the replys guys and stay safe.

Well, at about day 58 the DPS website had still said "processing application". So, I decided to go ahead and send a polite email over to the CHL's department as suggested and as I expected them to go over the 60 day processing time period. The email exchange ensues:

Instead of saying "processing application", it now says "No application or license/certificate active". :shock: Now, can anyone please explain to me what that means? No application active? I certainly hope my email exchange didn't tee them off over there. :???:

Hello everyone. I, like aggie dad, have been lurking about on the forum for a while and also decided to finally chime in. This is a great forum with great information. Thanks to all, especially Charles. :grin:

Aggie Dad, it seems we are in a similar situation here. My application was received by DPS on 12-12-05. I've yet to receive any confirmation letter or pin number as well, although I have spoken on 2 occasions with the kind ladies over at the DPS office. I was basically told the same thing that I've seen posted here on this discussion thread; which is that they are running behind in logging in applications. What bothers me most at this point is that they apparently did not have any problem cashing in my money order a week after they received my application. But, I digress. :???: Like many others I'm expecting the worst and hoping for the best. I also hope for changes in legislation that will allow this to be a smoother process.
