By Jeorge Zarazua - Express-News Atascosa County authorities don't anticipate filing criminal charges against a business owner who shot and killed a 25-year-old man Wednesday night during a failed robbery attempt.
Meanwhile, they continue to search for another gunmen who fled from Larry's Game Room near Poteet after his accomplice was fatally shot.
David Soward, chief deputy of the Atascosa County Sheriff's Department, said the two gunmen entered the business, located on Texas 16, at about 11:45 p.m. Tuesday, seeking to rob it.
Soward said one of the gunmen carried a shotgun, and the other a pistol. He said the one with the pistol fired one round into the ceiling, ordering a female employee to the ground as the other robber pointed a shotgun at her.
It was then that business owner Larry Horn walks out of the back room with a .40-caliber semi-automatic weapon, startling the robbers, according to the chief deputy.
Soward said the robber with the shotgun turns to aim at Horn, but that the business owner fires first, striking the man in the head and killing him instantly. The other suspect then runs out the door.
“We think we know the identity of both of them,” Soward said, adding he's awaiting fingerprint confirmation on the dead gunmen before releasing his name.
He said no customers were inside the business when the robbery occurred and that the employee wasn't hurt.
“Horn was brought in for questioning and we took a statement from him, but we don't anticipate any charges at this time,” Soward said.
