it's an improvement to property that lies in a flood plain and thus has an effect on the flow of water. It may redirect the flow of heavy rains, in which case it must withstand 100-year rains because if it fails it might be catastrophic, or it may act as a dam, in which case, being a simple earthen dam, it will LIKELY fail and release a backwash (and if it's in the Colorado River floodplain the LCRA will want to know about it).
