Isn't refusal to take an in situ sobriety test an automatic "something or other"?
So what does that say if the officer doesn't ask the citizen to take one? Maybe miajaipi is right and they knew the citizen would pass, and then they would be obligated to disclose the exculpatory evidence.

In some states, the area off limits to legally carried guns is also off limits to minors.

Intoxicated is intoxicated. If someone is too impaired to legally carry, they're too impaired to legally drive. That includes not only the uisge beatha prohibited to Muslims, but OTC and prescription medicine as well.
