Sorry, you are correct. Capital murder was what he was charged with, and that carries life without parole. He plead it down to murder and got life plus 20 years, so that means 40 years plus 20 before parole eligible.ELB wrote:I think for capital murder the only two punishments are death or life without parole. For murder they can be sentenced from 5 to 99 years or to life. If sentenced to life he must serve at least forty years Before eligible for parole.

Re: Shooting Situation at Rolling Oaks Mall San Antonio
For capitol murder they are eligible for release on parole, but not until the actual time served equals 40 years, without consideration of any good conduct time. In this case he was sentenced to life plus 20 years, so that should be 60 years minimum before allowed possible parole. Since he is 35 he will probably spend the rest of his life in prison.Abraham wrote:Does 'life in prison' really mean 'life in prison' or is it a euphemism for just a few years in prison, then parole and then BAM out?

Re: Shooting Situation at Rolling Oaks Mall San Antonio
The other two shooting victims have been identified. Husband and wife, both Principles in Willis ISD. Hit by shrapnel, but released and recovering. LTC has not been identified. I say no reason to know who they are if they don't want to be identified.

Re: Shooting Situation at Rolling Oaks Mall San Antonio
Police are now saying only 2 people, a man and a woman, not three as initially reported, were shot and injured by the escaping robber. Two other women were taken to the hospital, one with chest pains and one with labor pains. The article believes the injuries were not life threatening, which is great news.
Also, the way this article reads it appears that the LTC was just someone else at the mall, not an acquaintance of Johnathan Murphy.

Re: Shooting Situation at Rolling Oaks Mall San Antonio
Reading this article http://www.ksat.com/news/second-suspect ... l-shooting, sounds like the timeline was both of them tried to stop the bad guys, unarmed guy was shot, then LTC shot one of the bad guys. Other guy runs off shooting as he goes.
Police said Murphy and another man confronted the two suspects who had robbed Kay Jewelers around 3:30 p.m. Sunday. They said one of the two suspected robbers shot and killed Murphy. The other good Samaritan also had a gun of his own and fired at the suspects, wounding one, police said. The second robbery suspect ran off also firing a gun in the process.

Re: Shooting Situation at Rolling Oaks Mall San Antonio
I don't blame the LTC, I might have done exactly what he did. It is possible that he or others were actually being aimed at or shot at as he pulled the trigger. The sequence of how it went down is not known, so we can only guess who was on first.jmra wrote:I agree with what you're saying, but once the first guy was shot wasn't the genie out of the bottle? At that point both guys are guilty of murder and really don't have much to lose. If the LTC does nothing the BGs more than likely panic and become very unpredictable. I just think at that point I'm more comfortable dealing with one armed guy than two. I hate that 3 people were injured but I also see a nightmare senecio where two desperate armed murderers are holding an unknown number of hostages in a police standoff.Keith B wrote:A couple of major mistakes were made by the first guy; 1. He tried to intervene, and 2. He tried to intervene unarmed with an armed suspect. And, while I can understand the concealed carry holder pulling and shooting, especially since the 1st guy had shot the Good Samaritan, it more than likely set the 2nd suspect to shooting as he ran out of the mall. Hopefully the three people injured by the 2nd guy will make full recoveries.
