Im still checking to find an official source
Edit:
So It looks like the max for that charge is 1 year. So the real question is what does it mean to be "Truly Dismissed". The county record states dismissed (screenshot above), when I called county records in Virginia they tell me it shows as dismissed. How do I figure this out?
If the charges were "truly dismissed" that would have been prior to your nolo contendre [guilty] plea and sentencing.
In other words, you have been convicted of a crime.
I defer to Charles, as he is an attorney, and I am not.

This Virginia website shows the sentence as 0-12 months.
18.2-57(A) Simple assault, assault and battery ASL-1313-M1 0-12M

Re: Need Help Check elegibility.
I agree with tbrown that the final authority is DPS.Steelfire wrote:There was never an official "Writ of deferred adjudication filed" to my knowledge, there could of been unknown to me, but yes I do believe it technically was.tbrown wrote:Welcome to the forum.
Only DPS can give you a firm yes/no and I never heard of them giving a firm yes without an application and fee.Steelfire wrote:Is there somewhere I can get a firm yes/no before I drop 200-300 on the CHL?
Ask ten people and get a dozen opinions. Here's one more. I think you have to wait until December because your arrangement sounds like deferred adjudication.
I believe the date is based on the conviction, rather than the sentence. Since the conviction was 2008, five years has passed so you are good to go.

Re: Need Help Check elegibility.
I don't think that would help. Have you checked the DPS website for all eligibility questions? There are some that don't pertain to criminal history.Steelfire wrote:I was thinking of just going into a local police station and asking with my court papers in-hand but I was not sure if they would help me.
For example domestic violence, drug and alcohol addictions and psychological conditions can affect eligibility for obtaining a CHL.

Your post is very recent. There will be some CHL instructors who can weigh in with they opinion.Steelfire wrote:Is there somewhere I can get a firm yes/no before I drop 200-300 on the CHL?

4/01/2008: I was arrested for Attempted Malicious Wounding
The charge was then amended to Assault and Battery
12/15/2008: Plea submitted Nolo Contendere for agreement of 150h community service to be done within 12 months supervised probation for the charges to be dropped
12/7/2009: Charged were Dismissed
I can't figure out through online Lit if I am eligible yet?
