I have been wondering if the parking lot had video. At the time I didn't think to look.rtschl wrote:Agreed, but the OP's situation was not at a gas station.Tracker wrote:Luckily, most gas stations have video.rtschl wrote:I'm late to this discussion, but I agree with Keith's comments above about being careful switching from CC to OC being perceived to alarm the person. Always call 911 in situations like this. I think OP did great.
I agree it is unlikely homeless will call 911 but what about a witness nearby who only saw you and your weapon and not the aggression towards you? Be the first to call.

I was fine telling the first guy no, it's the second guy that things went south.Mick22 wrote:I attended U of H - Downtown and at least once a month, they would report a robbery or assault of a student near the campus. Most of the descriptions were that of a homeless person(s).
So, I wouldn't be surprised if their intent was to rob you.

Re: I had an uncomfortable situation last Saturday
I called [Pre-paid legal service] ( I'm a member) and I ran the scenario by them. I asked them what I could have done better and made their job easier. The attorney I talked with said I could have said, stop or I'll call the police then if they didn't disperse I could have escalated to the next level.
He also added that I should have called the police to give them a heads up.
Thank you everyone your input and help has made me better prepared.

Re: I had an uncomfortable situation last Saturday
When the second guy came out is when I felt I was losing control of the situation.imkopaka wrote:As for justification, it seems you could have made a case for it. You were outnumbered by people who clearly wanted money and advanced toward you in a threatening manner despite your clear orders to stop. Attempted robbery would not be that difficult to justify.

Re: I had an uncomfortable situation last Saturday
Is raising my hand towards the 2nd guy and in a very authoritative voice saying STOP! A verbal threat ?imkopaka wrote:Theoretically, if you didn't make any verbal threats and didn't remove the pistol from the holster, then you didn't threaten them. If your pistol was in a belt holster (regardless of IWB/OWB) then you didn't violate the rule against "intentionally revealing" your gun -- you just switched from concealed carry to open carry.

I'm not sure, they stopped advancing and it deescalated the situation.Jketchum wrote:Might be a dumb Question, but is raising your shirt reveling your holstered weapon to stop a threat / potential threat illegal?
At that point I was scared, but was I justified?

It's worth discussing, would the local law enforcement believe 2 local homeless guys over 1 out of town CHL holder?twomillenium wrote:That's what you say. Re: I had an uncomfortable situation last Saturday
That's true, since we had never been to San Antonio I wasn't sure where I was going to park I was happy to find a lot less then a block from the restaurant.Bryanmc wrote:I see the point they're making. You dropped your MIL at the door and could have just as easily picked her up at the door, thus leaving the space vacant for a handicapped person who was driving themselves. It would have saved your MIL the walk to the car after dinner as well.

If they're present aren't they utilizing it?WTR wrote:That's not what the DMV (TX) told me. Yhe owner of the card must be utilizing the card......not just present.JALLEN wrote:It's not illegal to use a placard to park as long as the person the placard is assigned to is present and was transported in the vehicle.
It is illegal to use the placard of another to park if that person isn't along on the ride.
Texas is rather generous in granting HC placards. I qualified for one here, being on supplemental oxygen for pulmonary fibrosis, but did not in CA.
I always take HC parking when available rather than the next most convenient spot, so a healthy person can park in that spot who cannot use the HC spot.

That's great advice, thank youScooterSissy wrote:I believe I would have. I didn't call the police, I probably should have but what would have said? Two homeless guys scared me?
You scared them off and went on to the restaurant. Then, 20 minutes later two policemen showed up asking to talk to you outside, as two men reported someone matching your description brandishing a firearm at them.
I'm a big believer that the first person to the police are have the most believed story, at least initially.
