1. The burglary charge I refer to is not the theft/robbery of the hat, it is a separate event. As shown earlier in this thread Kino has in the past been charged with burglary. I have read in comments elsewhere that this was burglary of a vehicle and the victim did not show to testify. Victims didn’t show up because they were saying racist stuff to this man. Hence theybdidnt want to press charges either.
2. As For the current incident, the allegations that the teens used racist remarks appeared rather conveniently, it seems to me. The News station that first reported on them quickly backtracked on that. I think they are properly relegated to the category of “fake news.”

No guarantee that the DA or the GJ would be logical (which is always the case), but if someone stepped up and told the punk to give the kid's hat back, maybe stood in the aisle, and punk escalated to violence, I don't see why "someone", LTC or not, could not defend himself within the law. As srothstein said, there was an assault and a theft. But it won't be a fine, if true. I see it as one of the easiest felony arrests some SAPD detective will ever get. When you combine an assault with a theft, you get a robbery. The video is pretty good evidence of both elements of the offense. The public has identified the suspect. All the detective has to do now is get the statement from the victim, put together an affidavit for a warrant, and go pick up the suspect. I am sure the DA would then bargain it down to a lower offense, but it is hard to not make it at least a state jail felony for theft from a person.
And while it is legal to shoot to stop a robbery, I would not recommend it for anyone in a case like this.
Now if the DA or the SAPD does NOT act on this, with all the publicity it's getting, they are saying it is open season on Trump supporters in San Antonio, and it will be time to step up one's defensive strategies.
This is an article that identifies the punk, and I think his case should be tracked closely, including three months down the road when the newscycle has rolled over about 1000 times and his lawyer is trying to get charges dropped or pled down to class Z misdemeanor mopery.
