Good for you. The onus is on the city to make sure signs are not posted so going to the city manager (and sending your complaint to him) is the right route, altho I agree with you about the gun shows not permitting licensed carry.rotor wrote:... Re: How to report improper §30.06 signs
See, SB273 wasn't really needed. Why is the Attorney General wasting government resources doing the bidding of a miniscule number of gun cranks? And the attorney general’s office recorded only seven complaints last month.
“Hopefully, that’s a good sign,” said Charlotte Johnson, a board member for Texas Gun Sense, a group that opposes loosening gun regulations. “It’s not that so many people are doing it just to make a stand.”
I know there is a line of thought to not have separate people duplicate complaints and not inundate the AG, but I think that this is a mistake, at least politically. Paxton may have enough fire in he belly to ignore such criticism (and it will come), then again he has his own legal troubles. He may come to the conclusion that he needs all the "good press" he can get, and using the AG's resources against "real" problems, ones where lots of people are complaining, is certainly plausible strategy.

I sat right outside the door waiting. I waited an hour when I look back at the door, and the sign was gone.
No official complaint filed. Just a copy of SB 273 and stubbornness.
Congratulations on your perserverence. I got quite a kick out of that story.

Re: How to report improper §30.06 signs
Of course you can do it yourself, but consider you are entering a specialized form of combat, the legal knife fight. Mr. Cotton has some expertise and insight into that arena. I'd go with what he suggests.locke_n_load wrote:Since the law does not give specific guidance on what should be submitted, is there any reason why we couldn't use our own letters/emails to make the notices, instead of what's on the TFC website?
I feel that getting a notary involved seems time consuming, when verifying if the person making the complaint is a citizen of Texas or CHL holder is not of much importance in regards to a complaint.

I don't know if the guy in the story knows what he is doing or not, but per SB 273, a citizen may give notice of a sign violation to the responsible governmental entity, and if the entity does not correct the problem within three days, then the citizen may make a complaint to the Texas AG, including a copy of his notice and noting the failure of the entity to comply with the law. The AG, if he decides to act, he must investigate, deterimine if there is a violation, and if so propose a penalty ($$$) and give the entity 15 days to correct the situation. If the entity still does not correct the violation, then the AG may sue to collect the penalty.
Mr. Cotton gives detailed examples of how to do the notice and provide evidence of non-compliance at the link to the Texas Firearms Coalition provided above.
Here is the enrolled version (sent to and signed by Governor) SB 273 text: http://www.capitol.state.tx.us/tlodocs/ ... 00273F.htm

Re: How to report improper §30.06 signs
Mr. Cotton,
Thanks for putting these up!
However, I went to the Forms Tab on the TFC website, and the "30.06 Affidavit" and the "Notice of 411.209 Violation" both open the same document, the "Notice" letter to the offending agency. (Actually, I think the 30.06 and the 411.209 lines are combined into one link).
If I am understanding your directions correctly, the affidavit is a separate document from the Notice and the Formal Complaint.
Thanks for providing the tools.

Re: How to report improper §30.06 signs
I just re-read SB 273, and realized I had forgotten that it also clarifies and narrows the restriction on carry at meetings of governmental entities:
(Note: [brackets] means text struck out, underline means text added.)
(Note: [brackets] means text struck out, underline means text added.)
As long as such a restriction exists, it is nice to see this change.Section 46.035
(c) A license holder commits an offense if the license
holder intentionally, knowingly, or recklessly carries a handgun
under the authority of Subchapter H, Chapter 411, Government Code,
regardless of whether the handgun is concealed, in the room or rooms
where a [at any] meeting of a governmental entity is held and if the
meeting is an open meeting subject to Chapter 551, Government Code,
and the entity provided notice as required by that chapter.

Re: How to report improper §30.06 signs
Mr. Cotton,
In your first post, you mention that there will be some forms on the TFC website to aid in addressing signs wrongfully posted by gubbmint entities. I don't see them there yet, will they be ready to go tomorrow? Hunting season is almost here....

Re: How to report improper §30.06 signs
The tax office on Bandera Road in San Antonio had a 30.06 sign long after it should have come down. I haven't been over there in a long time, but if it is not gone yet, anyone living in the Leon Springs area should keep an eye on it.
