There's no infringement when you willingly cede your right in exchange for whatever they're offering you. Don't like the terms? Don't buy the product/service.

Why does anyone care what their "policy" is???

I want to know if they understand 30.06 and 30.07. They have a way to accomplish keeping someone out and it's not by publishing their "policy".

Give an official 30.06 or 30.07 notification.
