I think the game warden would be the best way also, for the reasons you stated. Thanks.Lynyrd wrote: ↑Tue Jul 16, 2019 2:25 pm IMHO that is not "livestock" and as such is not covered by agriculture codes. Elk are defined by Texas Parks and Wildlife as an exotic species.
https://tpwd.texas.gov/regulations/outd ... er-speciesExotic Animals And Fowl
An exotic animal is any animal that is not indigenous to Texas, including but not limited to aoudad sheep, axis deer, elk, sika deer, fallow deer, red deer, and blackbuck and nilgai antelope. An exotic fowl is any avian species that is not indigenous to Texas and is also not protected by the federal Migratory Bird Treaty Act, including but not limited to ratites (emu, ostrich, rhea, cassowary, etc.).
It is UNLAWFUL to:
hunt an exotic without a valid hunting license (Class C misdemeanor);
hunt an exotic on a public road or right-of-way. (Class A misdemeanor);
hunt an exotic without the landowner's permission. (Class A misdemeanor); or
possess an exotic or the carcass of an exotic without the owner's consent (Class A misdemeanor).
However, the ear tags imply that this animal is owned by someone. If it were mine, I would be very unhappy to find out that someone killed it and i would do whatever I could to see that they were punished to the full extent of the law (whatever laws apply).
Personally, I would call the local Game Warden's office in that area and tell them where it has been seen. They may very likely have some information about where it came from and who is missing one of their elk. It could then be darted and returned to its owner.

Re: Need your opinion
The animal is not destructive, no more than any deer. He wanders in and out as he pleases. He shows up in camera a couple days a week, or has been for about 2 months now. If he came from a game ranch, which is what I assume, it must be fairly far away as I do not know of anyone who has brought in elk. Well,thanks again for all the responses. Looking at the photos, this animal sure don't like the Texas heat.

Re: Need your opinion
Thanks for all the replies, I agree about not shooting, didn't seem right to shoot something imported.

Need your opinion
I hunt deer in the hill country and keep a few cameras set up just to see what is out there. A couple of weeks ago a young (2 year old?) elk started showing up. He has ear tags in both ears so he must have escaped from somebodies game ranch. I have a question for the lawyers and one for the hunters, 1) would it be legal to shoot the animal during hunting season, more important, 2) would it be ethical? I am in the camp of not to shoot, I believe this animal "belongs" to someone but is that how the state of Texas looks at it?
Thanks for any input.
