The last military execution was April 13, 1961 of a Private convicted of more serious crimes than misconduct in front of the enemy and desertion. We do not have summary executions anymore and attempting to do one might lead you to a nice cell in Leavenworth. What give me hope is that they were suspended for their actions so perhaps it is not too far gone.
This case isn't about the military though and police officers in a modern society shouldn't be unloading into a car unless they have a darn good reason to (see the attacks in Paris as an example). Fleeing from the police is not an excuse to execute people.
