Actually Mamabear yes we do, and Bowe Bergdahl is one that it could have happened to
The last military execution was April 13, 1961 of a Private convicted of more serious crimes than misconduct in front of the enemy and desertion. We do not have summary executions anymore and attempting to do one might lead you to a nice cell in Leavenworth. If we, as a nation (and military) were willing to try Nazi's before hanging them the same should apply to anyone else.

This case isn't about the military though and police officers in a modern society shouldn't be unloading into a car unless they have a darn good reason to (see the attacks in Paris as an example). Fleeing from the police is not an excuse to execute people.
